DRUMINI – TERMS & CONDITIONS
1. Ownership and Transfer of Title
1.1 Ownership of all goods remains with Drumini until full payment of the invoiced amount, including all secondary charges such as interest, penalties, and expenses.
1.2 Title transfers to the Customer only after the complete payment is received and cleared in Drumini’s account.
2. Orders, Delivery, and Force Majeure
2.1 Drumini will make reasonable efforts to deliver goods within the agreed timeline. Delivery delays will not constitute grounds for cancellation or rejection unless clearly stated in the Purchase Order.
2.2 All orders are accepted and executed subject to Force Majeure conditions (including strikes, natural disasters, transport disruptions, or any event beyond Drumini’s control).
2.3 Goods may be dispatched through any suitable transportation mode at Drumini’s discretion unless mutually agreed otherwise.
2.4 Delivery charges, unloading, and lifting charges—where applicable—must be borne by the Customer. Delivery does not include unloading/lifting; the Customer must arrange these at their own cost.
3. Payments and Interest
3.1 Payments made via cheque or demand draft will be credited only upon successful clearance. Dishonoured cheques will attract action under the Negotiable Instruments Act, 1881.
3.2 Overdue payments will attract interest at 24% per annum, calculated from the date the invoice becomes overdue, without further notice.
4. Risk and Responsibility
4.1 Once goods are delivered to the Customer or their representative, all risks— including loss, theft, or damage during storage, handling, or pre-installation—will be borne by the Customer.
4.2 Drumini is not responsible for damages resulting from improper usage, adverse environmental conditions, mishandling, incorrect storage, or non-compliance with recommended installation guidelines.
5. Product Warranty and Limitations
5.1 Drumini products are provided on an “as-is” basis. Warranty is limited strictly to manufacturing defects verified by Drumini’s authorized personnel.
5.2 In the case of a valid defect, Drumini may repair or replace the specific defective product or part at its sole discretion.
5.3 Drumini is not liable for any consequential, indirect, or incidental losses, including fabrication, labour, rework, or additional material costs.
5.4 Drumini’s total liability will not exceed the invoice value of the defective product.
6. Conditions Not Covered Under Warranty
The warranty becomes void if defects arise due to:
• Improper installation, fabrication, or workmanship
• Mechanical or chemical damage
• Use with incompatible materials
• Natural wear and tear
• Exposure to excessive moisture, humidity, or extreme temperatures
• Water seepage, plumbing failures, or structural defects
• Incorrect storage or handling
• Abnormal or harsh usage conditions
• Exposure to chemicals, oils, solvents
• Accidents, misuse, abuse, or impact from heavy objects
7. Claims and Complaints
7.1 Claims related to manufacturing defects must be reported within 48 hours of delivery. Claims submitted after this period will not be accepted.
7.2 Drumini will arrange an inspection by authorized personnel to verify the issue on-site.
7.3 Drumini’s decision after inspection will be final and binding.
7.4 Claims are valid only for the original purchaser and cannot be transferred.
8. Returns and Replacement Policy
8.1 Goods once sold cannot be returned or exchanged except in cases of verified manufacturing defects, transit damage, or incorrect supply.
8.2 Issues must be reported immediately at the time of delivery for eligibility.
8.3 If the exact replacement is unavailable, Drumini will provide the closest available alternative.
9. Customer Responsibilities
The Customer is responsible for:
• Inspecting goods at the time of delivery
• Arranging unloading and lifting where applicable (charges apply if assistance is requested)
• Ensuring proper storage, handling, and installation
• Ensuring the product is used in compliance with all applicable laws and safety standards
10. Website Use and Data Privacy
10.1 Drumini collects personal information only when voluntarily submitted through enquiry or contact forms.
10.2 Cookies may be used to improve browsing experience. Personal data is not shared with third parties without consent.
10.3 Data is used solely for responding to enquiries, providing services, or improving website performance (including analytics).
10.4 Appropriate security measures are implemented to protect personal information.
10.5 Drumini is not responsible for the content or privacy practices of external links present on the website.
11. Limitation of Liability
11.1 Drumini is not liable for damages resulting from improper use, unauthorized alterations, or failure to follow recommended guidelines.
11.2 All risks associated with usage remain with the Customer.
12. Children’s Privacy
Drumini does not knowingly collect personal information from individuals below 13 years of age.
13. Modifications to Terms
Drumini reserves the right to update or modify these Terms & Conditions at any time. Latest versions will be made available on the website.
